Scope of Application

These general terms and conditions of sale (hereinafter "GTC") govern the sales of sports photographs made by the companyWildness Visual, a sole proprietorship based in Belgium, exclusively for individual consumers via its website.

Any order implies the full and unconditional acceptance of these GTC by the buyer.

Products

The products offered are digital sports photographs, available for online purchase. Each photo is provided in JPEG format or equivalent, in high resolution suitable for useon the internet, social networks, as well as forprinting up to a maximum A3 size. 

Order

The order becomes firm after payment has been validated by the customer. The company reserves the right to refuse or cancel an order in the event of an existing dispute with the customer or non-payment.

Prices and Payment

Prices are indicated in euros, including VAT. Payment is made immediately upon ordering, by the means offered on the site (credit card, PayPal, etc.).

Delivery

Photographs are deliveredexclusively in digital format, via a download link sent by email to the address provided by the customer, within a maximum of 72 working hours after payment confirmation.

No physical shipment is planned. It is the customer's responsibility to verify the validity of their email address before finalising the order.

Right of withdrawal

In accordance with Article VI.53, 13° of the Belgian Code of Economic Law, the right of withdrawal does not apply to the provision of digital content not supplied on a tangible medium, the execution of which has begun with the express prior consent of the consumer and for which they have waived their right of withdrawal.

By validating their order, the customer expressly agrees to receive the digital photographs immediately and thus waives their right of withdrawal.

Refund

No refund can be granted after the delivery of the digital files.In the event of a proven technical problem (corrupted file, obvious error), a new version of the file will be provided at no additional cost, after analysis of the request.

Liability

Wildness Visual cannot be held responsible in the event of an error attributable to the customer (incorrect email address, mishandling of the file, etc.) or technical problems beyond its control (server failure, faulty messaging service…).

Personal data

The personal data collected is used solely for the management of orders. In accordance with the GDPR, the customer has the right to access, rectify, and delete their data by contacting: info@wildnessvisual.com.  

Applicable law and disputes

These general terms and conditions are subject to Belgian law. In the event of a dispute, an amicable solution will be preferred. Failing that, only the courts of the judicial district of the registered office ofWildness Visualwill have jurisdiction.
